A Case of She Said, She Said

Deputy Secretary of Labor Cinta Kaipat has blasted Rep. Tina Sablan's bill to grant enhanced status under CNMI law to long-term guest workers. Here is one of many criticisms that Kaipat leveled against the bill, as reported in the Saipan Tribune:

“This bill is lopsided special interest pleading in favor of the foreign workers. The drafter of the bill has no interest in the plight of Commonwealth citizens who are out of work,” [Kaipat] said. Kaipat said a move to bring 20,000 aliens into a new “status” in the CNMI would cause a serious adverse reaction in Washington D.C. “This very large number would be a deliberate slap in the face to the authors of the federalization bill which rejected this very provision (status for persons who had been in the Commonwealth for five years) and instead used provisions that seek to deport all these people over the next five years. It might even invite even more punitive legislation in the next Congress,” Kaipat said.

Tina Sablan responded, as reported in the Marianas Variety:

“It is incorrect to suggest that the proposed resident foreign national program would result in a significant population increase,” [Sablan] said. “Current CNMI law allows foreign national workers who meet certain income requirements to bring in their immediate relatives; these same requirements would apply to resident foreign nationals who apply for resident foreign national status.”

She added, “As an attorney, former legislator, and current deputy secretary of Labor, Ms. Kaipat should know that her criticisms are legally insupportable.”

Tina Sablan's bill will make absolutely no difference soon anyway. The US House passed the federalization of our immigration today, which means the end of contract workers on Saipan is coming very rapidly now. The entire point of their bill is to phase out contract workers and replace them with locals. You have been blinded and lied to about the real intent of this bill, but you will soon find out the hard way.

What a tragedy for our community. This response is cold hearted, poorly conceived, inaccurate, economically flawed, racist in intent, and a complete disappointment in every respect. One thing this letter is not, and that is a surprise. Big business is quite predictable and our puppets here follow the script to the letter.

My compliments to Representatives Tina Sablan, Victor Hocog, Heinz Hofschneider, and Edward Salas for offer such a progressive piece of legislation.

Wow.. I've spent so much time on Kaipat, it's almost exasperating to continue. I'll keep my thoughts short and to the point. Kaipat's a xenophobic blow-hard with a huge chip on her shoulder. The author of PL15-108, a horrible public labor law, whose loudest supporter is Goro and few others, who follows that law up with this horrible statement "foreign workers who can’t stand the local labor system can leave", and questions the Marianas Variety reporting about the law, stating "All you report are negative things", loses an election and then is conveniently hired at the Department of Labor, and after all of that.. then tries to promote her piece of sh#t law to non-residents as being "better for the CNMI's guestworkers", has absolutely NO PLACE challenging a bill that seeks to level worker playing fields and at the same time, remove some of the barriers that permit non-residents to be treated as second-class employees and citizens, authored by Congresswoman Sablan.

As I've stated before.. Kaipat's the last person we should have working at Labor. The CNMI would be better served by reassigning her to a guard position at the correctional facility.

priority one should be the local workers. that's not to say that guest workers should be cast aside.

i love the guest workers. they've done so much. the cnmi would be smart to offer longterm status to some, but not all.

everything should be handled on a case-by-case basis. if people think they "deserve" to stay here, let their stay be analyzed, their status be recommended upon by labor and served up to the governor for approval.

it's a moo point (it's like a cow's opinion. it doesn't mean anything. it's moo) because everything will be decided by the feds anyway.

just don't demonize cinta for doing her job by sticking up for the locals.

Hi Brad,

The question has nothing to do with love and hate, it is more about right and wrong. The people defeated her in the general election and that alone should have sent a message that local voters were insulted by PL-15-108 and she should never been placed in the labor department. She has further lost credibility by signing letters written by other people who were ashamed to sign such deceitful and terrible content.

I would not paint her as a champion for locals because a puppet for a disgraceful administration is a more accurate assessment.

When US labor and immigration arrives, Brad, apply for a job, because she will be gone.

see, the way it works is that you have to give something concrete when you make a statement like:

i was writing in defense of someone whom i think is a nice lady doing her job. i wasn't mentioning specific policies or track records.

if you want me to back up what i said with a reference, well then here, use this:

"say what you will, but cinta is not the bad person you're making her out to be."

i'll note i was walking down the beach maybe three or four years ago when cinta and gus, whom i didn't even know at that time, invited me over to share in their barbecue.

that is one of the many experiences that made me fall in love with the cnmi.

if someone wants to show some concrete analysis they should bring something to the table that offers proof to the allegations of cinta not writing her own policies.

i give plenty of references to bolster my opinions based on specific comments.

maybe you refer to this:

Brad, when people make grossly racist generalizations as she did in her letter, they need to be held accountable. Suppose someone had said, "many Chamorro people are undesirable. They have been found by hearing officers to buy and sell forged documents, perjure themselves in hearings, engage in fraudulent employment and generally disrespect Commonwealth law." I think we would all agree that person would be a racist pigfucker. I hope you would not defend someone who expressed such hateful views. So why should Cinta get a pass for saying exactly the same things about Filipinos and Chinese? Only a small minority of them engage in the conduct described, as do a small number of haoles and locals. The Secretary of Labor and his deputy are supposed to be there to protect the workers, not stir up hatred against them. We need these workers to fill many of our jobs. Her comments hark back to pre-civil war "shiftless darkie" talk which has no place in modern society. If she wants to say such things, particularly in print, she should never be allowed to say them on behalf of the people of the CNMI. She should find some Nazi skinhead group to flack for.

Brad, here’s a link to Cinta’s letter. As I see it, her big mistake was in the use of “many” rather than “some.”

Of course “many” is correct in an absolute sense (thousands of foreign scammers and ne’er do wells — just as there are thousands of locals who have appeared before our courts, or mainlanders running away from problems there, etc.), while “some” is correct on a percentage basis, and of course more politically correct.

Deputy Secretary Kaipat was undoubtedly focused on the indigenous inhabitants of the CNMI when referring to the ultimate goals of the proposed legislation, and the focus on the absolute definition is what one could expect from one working in an agency that has to deal with the problems, and much more so than with the many more who are productive, contributing members of society.

People will see what they want to see. There seems to be a lack of charity in the motives we attribute to others.

Ms. Kaipat might have benefitted by circulating her letter for a bit more editing before its release. Then again, maybe she didn’t choose the right editors. Some folks in the Administration hold their cards notoriously close to their vests.

So close, that even the Ombudsperson can’t fix things!

Sure, Cinta and her siblings can show local hospitality. That's what we would expect. But what does it demonstrate? That they could be good at promoting tourism?

Have you seen her extend the same hospitality to guest workers?

Are the statements in her letter reflective of a neutral and impartial magistrate or do they smack of invidious bias?

She wrote a good letter (probably herself) in support of Angelo and the Pew proposal, but does that excuse genocidal attitudes?

None of the points in her letter, even if true and accurate, are justification for denying enhanced status to aliens who do not meet that description.

Cinta's letter reflects the view that aliens are responsible for all unemployment among locals. Do you believe that?

If you do, it means you believe that Commonwealth law giving employment preference to locals means absolutely nothing and that the administration of labor and immigration by locals in the government is totally ineffectual.

Everybody knows Ricky Delgado and PTI are puppets of Tan, the product of secret financial arrangements in the Philippines. Somehow that just might influence your political views, we thinks.

As Zaldy Dandan has pointed out, Rep. Tina's bill ought to be supported for economic reasons alone, but Cinta just hates too much to get it.

i’ve found that the law means absolutely nothing in many cases. how do i know? i've been there, baby.

the job vacancy announcements mandated by the department of labor are for renewals, and foreign workers holding human resource positions aren't hip to hiring locals to supplant their friends.

it’s tantamount to firing a friend. i know how it’s viewed in the foreign worker community because i have friends who are foreign workers and they’ve explained the renewal process from both sides—management and labor.

i also know about the joke that the jva is because i've been there. ask actual local people searching for jobs in the private sector. if you're just a local guy looking for a job you'll have a tough time trying to get an interview.

even if you get in the door, most employers have already made up their minds to renew their foreign staff. the only reason companies put the jva's in the paper is because of the d.o.l. mandate.

it's wrong and counterproductive. if there are people here willing and able to do the jobs held by foreign workers then they should get them—plain and simple.

the foreign workforce should on be here to supplement the local workforce.

if someone from saipan applies and qualifies for an accounting job currently held by a foreign worker who is coming to the end of his or her contract, then the local person should get the job and the foreign worker should transition home, as per their respective contract.

if another company needs an accountant and can't find one locally, then that foreign worker who was scheduled to return home could be considered for the position. that way, the second employer could save on the round-trip ticket and possible time lost.

everyone wins.

the guest worker program wasn't dreamt up as salvation for foreign countries. it was meant for the cnmi to gain instant access to a massive pool of inexpensive foreign labor.

that's not a terrible thing to say. it doesn't carry racial tones. it doesn't pander to the lowest common denominator.

i've been there, dude. i know what i'm talking about. hey, before i got the job with the tribune, the h.r. lady said, "you'll be working with all filipinos. are you going to be okay with that?"

can you believe it? first of all i'm pretty sure that they could have been hammered in court for saying that to me. second, i think that statement was meant to try and dissuade me from pursuing the job.

i asked her why the fact that they were filipinos would make a difference. she said, "well, you might not understand what they're saying all the time."

and another thing,

i think you're making quite a leap. nobody has ever said anything about killing people. perhaps you’re taking things a bit too serious here. well, not serious enough to take a stand as an actual person.

you just take pot shots without fear for reprisal. if these discussions really meant anything to you at all then you'd stand up and be recognized.

and yes, in a case like this, your identity is as important as your statement.

Brad, sounds like you are saying the CNMI labor and immigration system is junk. I have a hard time figuring out how you reconcile that view with opposing federalization and hostility to the pleadings of long-term alien residents, let alone being an apologist for Cinta's outrageous letter.

The CNMI system fails because it is an attempted regulatory solution not an economic one. It divides local workers from alien ones by creating a perception among local workers that alien workers get a better deal while holding the alien workers to a system of indentured servitude and demeaning treatment by DoL personnel. This precludes worker solidarity and thus holds wages down and creates opportunities for exploitation.

The quest for improved status for long-term alien residents -- an activity guaranteed and protected by the United States and Commonwealth constitutions -- is designed to break through this and bring free labor market forces into play.

The CNMI DoL ought to be focused on getting local workers employed in decent jobs, not on holding foreign workers down.

Years ago, I proposed (without success) real economic solutions to this problem: tax businesses for the privilege of employing alien labor (on a per worker or modified basis), tie the tax rebate to the total wages paid local workers, increase minimum wage to attract local workers to the private sector (with benefits commonly received by alien workers either deductable or included in determining the effective wage for purposes of compliance), liberatation of workers from bondage to a single employer, fixed terms of stay, nonrenewable for each new worker entering, but freedom of employment for that term.

The argument that long-term alien residents should not receive an improved status on grounds that they came here to work knowing that they were not being offered a right to immigrate or to permanent residency is a complete canard. There was nothing in their contracts that said they were prohibited from adjusting their status to any other status that might be legally available, or requiring them to give up their constitutional rights to free expression and petitioning the government.

BTW, I think "not buffaloed" was speaking allegorically or metaphorically with the reference to genocide. As Zaldy Dandan pointed out in his column last Friday, when you stab someone as many times as Cinta did Rep. Tina and alien workers in that letter, you must really dislike the victims.

i am all for someone wrangling the department of labor into shape. if it's the feds, so be it.

but...

i am not for the united states taking over control of the cnmi's borders.

yes, i know the u.s. can. end of story, right? well, how about a happy medium.

let the feds get the hiring, wages, and working conditions part of the equation in line with the rest of the country.

even the feds say that our labor system is the problem. so why take over the cnmi's ability to allow tourists (tourists, not terrorists) to enter the islands?

for a couple of reasons. the main one is that federal labor and immigration are linked.

china and russia are the only countries that will really have problems coming here.

as much as i hate to say it, in the not too distant future, china is going to kick some serious economic ass in the region.

now, the cnmi won't be able to capitalize on all of those tourist dollars. i think that sucks.

let the cnmi continue to allow tourists from any countries it deems fit.

it's not like they're going to escape and penetrate the u.s. orders.

fix labor, let immigration be.

it doesn't have to be a blanket change...well, not in my perfect world anyway.

first, i'd really like to read tina's bill so i can better grasp the points mentioned in cinta's letter.

second, i've read cinta's letter and i didn't find it racist. nationalistic? maybe. racist? no.

there were generalizations made about acts and schemes perpetrated by guest workers, but none of them based on race.

sure, it could have been worded differently to communicate some of her points more effectively.

it was laced with emotions, but race was never mentioned once.

third, my biggest question is this: who do you really think wrote that letter and asked cinta to sign it?
