Whatever happened to this Federal investigation? What is the status?

Ex-AGO lawyer sues Hutton for alleged harassment

By John Ravelo
Reporter

An attorney formerly working for the Attorney General's Office filed a lawsuit in federal court yesterday, accusing then chief prosecutor and now special assistant attorney general David Hutton of sexually harassing her.

Karen Linwood Severy also accused several attorneys at the Attorney General's Office of retaliating against her, especially when she initiated administrative complaint of harassment in the workplace. She said Attorney General Pamela Brown refused to take action on her complaint against Hutton's sexual advances and even retaliated against her by demoting her and terminating her employment.

In a 47-page complaint at the U.S. District Court, Severy's lawyer, former Attorney General Robert Torres, elaborated on Hutton's alleged sexual advances that began in September 2003, two months after Severy joined the AGO as narcotics prosecutor.

Torres impleaded Hutton in his official and personal capacity, the Attorney General's Office, and still unnamed defendants in the lawsuit, asking the federal court to impose punitive damages to the maximum permitted by law on various causes of action.

Severy began working for the AGO on July 4, 2003, on a contract that was scheduled to end by July 3, 2005.

In the complaint, Torres said Hutton began seeking out Severy for advice on a personal problem. Hutton then allegedly escalated personal communications with Severy even though she tried to distance herself from him.

“During these episodes, Hutton made frequent, vulgar references to women and sexual matters, commented on the bodies of his female companions, and informed Severy about his desires to engage in sex with various female co-workers,” Torres said.

Torres said Hutton also frequently called her at home.

Torres said Severy did not immediately initiate a complaint against Hutton for fear of losing her job. Hutton allegedly changed his treatment of Severy as a respected colleague and began discrediting her, sometimes shouting at her in the presence of co-workers.

Despite this, Hutton allegedly continued telephoning Severy at home.

Torres said Severy met with Brown on Feb. 13, 2004, expressing her discomfort over Hutton's alleged increasing requests for physical contact. Although Brown promised to look into the matter, Torres said she did nothing to alleviate Severy's working condition, did not relieve or reprimand Hutton, and instead reprimanded Severy for her inability to get along with the then chief prosecutor.

“In response to Ms. Severy's complaints about Hutton, Brown took reprisals against Ms. Severy. These reprisals included, but were not limited to, a salary reduction, demotion, and termination,” Torres said.

Brown allegedly retaliated against Severy for bringing up harassment complaints, directing Hutton to reassign the attorney to the Civil Division effective May 3, 2004 and reducing the amount of promised salary increase, among others.

Brown allegedly interfered with the discrimination complaint filed by Severy with the Office of Personnel Management, assigning assistant attorney general Edward Buckingham as the AGO's Equal Employment Opportunity coordinator.

“Brown was well aware of Hutton's propensities, knew about his treatment of female subordinate employees, and by turning a blind eye toward Hutton, facilitated it, approved it, and condoned it,” Torres said.

Severy's termination by Brown became effective on June 15, 2004.

Before this, Severy filed a sex discrimination complaint with the EEOC on April 23, 2004. The EEOC issued a notice of right to sue to Severy on March 31, 2005.

Why did Wendy Doromol delete this from her blog? Is she protecting Pamela S. Brown and Edward T. Buckingham?

The case was settled for an undisclosed amount.

Anonymous said...

Wendy Doromal is protecting Pamela Brown Blackburn (her real name)because she is the Federal Ombudsman. She believes that with Pam's help, contract workers will be given a 'pathway to citizenship'.

Never mind the Federal EEOC investigation and the years working for Juan Babauta and his cronies.

Wendy still nips at the heels of anyone involved with the garment industry no matter how long ago 'something' may have happened.

One curious example is that Juan Babauta fought AGAINST Federal takeover and PBB was right there at his side. Even Wendy can't spin this.

Wendy ran a really good blog about minimum wage, etc. I wonder how much the Ombudsman paid the Filipino workers who built her and Mark's mansion?

Wendy?

NEWS FLASH: Janet King is running for US Congress

Anonymous said...

I am not sure that Pamela Brown Blackburn is her legal name. Is that the name listed on the title to her Papago mansion (ill-gotten gains from the garment class action lawsuit) in the Commonwealth Recorder's Office?

For years she was listed in the Washington State Bar Association as Pamela Sue Brown. Now she is listed as simply Pam Brown.

http://www.mywsba.org/Default.aspx?tabid=177&ShowSearchResults=TRUE&City=Saipan.

In the CNMI she has prefered to use Pamela Brown for professional "legal" documents.

There are hundreds of people with that name on the mainland, all the better to hide amongst if she gets sued. It is much better to use her full name, whatever it is.

Anonymous said...

Ill gotten gains is right. It's funny how Wendy Doromal called Tim's statement 'snarky'. Pam got 250k as part of a settlement. The 'abused' garment workers made a lot of lawyers rich including Pamela S Brown. How sad. Wendy is so delusional she jumps from one foot to another trying defend these people.

We would like to know a few things.
One, during her time at the AGO how many (if any) SeaFix contracts went through her office? Were any of these contracts 'pushed' through? Was any Federal money involved?

Yep, that's sweat on your forehead.

Check that Washington State bar list (two posts up) again. Jim Benedetto is never going to prosecute his predecessor/ successor/ fellow Washington State buddy.

She finished her time at the OAG in January 2006. Has the statute of limitations run? Someone should notify the DoJ Public Integrity Section, or the Inspector General of the agency that made the grants -- likely Interior or Homeland Security.

The Babauta administration was even more corrupt than the current one, but they have skated for the most part.

Sorry for my bad english. Thank you so much for your good post. Your post helped me in my college assignment, If you can provide me more details please email me.

That case was dismissed with prejudice.

Anonymous said...

Dismissed with prejudice just means that the case is completely over.

The lawsuit settled. DH was a known alcoholic womanizer who had a record of making lewd remarks towards female colleagues. This one went too far. Karen filed and the EEOC SUPPORTED her 100%. There was a Federal investigation.

What needs to be known is how far did the AG go to shutting up Karen and trying to wiggle her way out. Karen was not only let go but humiliated and embarrassed.

Those defending this (Dorormal) should be ashamed.

Someone should file an Open Government Act request with the Department of Finance to find out how much was paid out on the settlement agreement.

Copies of all materials connected with payments related to the settlement of the Severy case filed in U.S. District Court.

Karen Severy also collected big bucks in the settlement of an earlier sexual harrassment case with the District of Columbia City Council.

Glen Hunter's dirty tricks said...

What's really funny is Glen Hunter denying on the Marianas Variety blog that he is “TheTruthHurts,” adding an extra “n” to his name for believability.

After years of commenting on this blog, it's a bit late in the day for that.

Then he claims that he couldn't possibly be seeking self-aggrandizement or self-promotion, because as The Truth Hurts he is “anonymous.” Nice try, Glen. Everyone on the island knows it is you.

To top it off, he gets outraged at those “desperate” to “uncover” his identity or “out” him, analogizing that to communist threats. Really? What have you been doing on these very blogs for two years?

The gig is up, Glen. You already cost Tina election to the CNMI Senate. Don't tarnish her efforts against cancer.

Aww. You are really upset with Glen aren't you?

You may want to take a remedial reading course. Glen has already stated that he doesn't mind if he is labeled as the writer behind THETRUTHHURTS.

Seems you are the one that is outraged and desperate.

I spoke to Glen and he is having a blast with this. Why not give him a ring or email him yourself since you care for him so much. I am sure he will laugh at you too :-)

You may want to follow-up those remedial reading courses with a visit to a counselor or a shrink. It appears that you have a major fixation with Glen. Poor thing.

Glen was fired from PTC at the request of the Governor. You can ask the Governor why he was fired.

Anonymous said...

How ironic, considering Glen frequently threatened blog commenters with opposing viewpoints that they should be fired for blogging on government time, for being incompetent, or for no reason at all.

What goes around, comes around.

Somehow, I suspect this episode will not teach Glen Hunter how to get along well with others, noe endear the Governor to him. In fact, that might explain the resurgence of vitriol.

Maybe Glen should sue!

Anonymous said...

I really like this Glen guy.

Seems as though the guy above [8:34 AM] does too.

Anonymous said...

Sue?

Why should he sue? It was PTC's loss.

Anonymous said...

Yeah, Glen has benefitted by not having to sell beer anymore. Now he can achieve his true calling.

Anonymous said...

Noni 8:34,

Glen never threatened anyone. I happen to know for a fact that the assumptions on this blog (and other blogs) about who Glen is and who certain anonymous posters are, are dead wrong.

Glen is goodnatured enough that he takes it all in stride and doesn't mind the vitriol that is directed at him, because it deflects from other people who might not be so thick-skinned and because a lot of it is, well, downright funny.

Also, what "episode" exactly should "teach" Glen to work well with others or endear the Governor to him?

Why on earth should he (or anyone) do anything to "endear" the governor to him? To even suggest it is pretty sick. Anyone who knows Glen knows him as a good person who is not a kiss-ass. The CNMI needs more good people who are not kiss-asses. We have way too many kiss-asses on Capitol Hill, that's for sure.

The governor, on the other hand, is a complete and utter failure of a leader. If anything HE should be working harder to endear himself to US.

Compared to the traditional cigarettes, smokeless cigarettes use no tobacco. Because of that, they release no carcinogens when they are used which makes them safe not only for the user but for others as well. Their use of e-liquid also makes them a big help in quitting smoking.

Hutton cleared in harassment complaint

By John Ravelo
Reporter
CNMI chief prosecutor David Hutton has been cleared in an investigation on a sexual harassment complaint filed against him by a female attorney formerly working for the Attorney General's Office.

Acting AG Clyde Lemons Jr. disclosed the information in a media release yesterday, a day after the AGO received the results of the probe.

“The investigation has been completed,” Lemons said. “The charges against Hutton were determined to be unfounded.”

Lemons said that, while investigations on Equal Employment Opportunity Commission cases are normally confidential, the AGO had to release the outcome of the probe because the existence of the complaint has been made public.

The Office of Personnel Management earlier confirmed the existence of the complaint filed by the attorney, whose name is being withheld.

OPM director Juan I. Tenorio earlier disclosed that he had tasked Frank Gibson, the chief investigator for the CNMI's Equal Employment Opportunity program, to conduct the probe.

He refused, however, to comment when asked for details about the allegation that became the basis for the sexual harassment complaint.

Hutton also refused to comment on the complaint, but said the female attorney last worked for the AGO on May 28. The attorney had worked under Hutton, who heads the AGO's Criminal Division.

From the June 2005 article:

----------------------------------

Buckingham then got the biggest pay raise of any AAG, from the low $50s to $65K per year, almost as much as his increase to $80K upon becoming AG in August 2009.
