Discrete or Discreet, That is the Shortfall

Lawmakers exceeding their quarterly discretionary fund allotments. What gives?

What are these funds for and how should they use it? Should the public need to know? What are the recent projects that the community has benefited from these funds so far?

Saipan Tribune reports that "Some lawmakers once again exceeded their quarterly discretionary fund allotments and therefore had to borrow from their colleagues or ask for the reprogramming of at least $9,112 in April to June to cover for budget shortfalls, up from the reprogramming of almost $7,000 in January to March...Each lawmaker was allotted $22,367 in the third quarter of Fiscal Year 2009 or from April to June, lower than the $26,217 allotted during January to March."

It would appear than that the problem is not Tina but the central governments waste of funds. Should she in turn waste funds on cell phones, car leases, tables, tents, unnecessary community workers, travel, etc. Is that really a solution? Are you trying to convince the public that it is? The wailing and gnashing over the trivial sums spent, squandered, lovingly used to nurture good governance, spent on crack (pick one) are much overblown. US 'lawmakers' even those without a vote like Kilili spend Millions each on the same kind of porkpie, not thousands like here in paradise.

The answer to all our woes does not come from our legislators sitting on the floor in their offices, crosslegged ooommmmmming until the true light hits them.

Spending those paltry funds imaginatively to help improve life for the constituency that hired you sounds like the right thing to do.

and the one public hospital is collapsing and people are literally dying while they wait for diagnostic tests, doctors to see them, and medical referrals to get approved,

and the retirement fund is about to go broke,

and citizens are still waiting for their tens of millions of dollars in judgment awards to actually get paid,

and cuc is facing costly stipulated orders, potential epa fines, coast guard fines, puc fines, and a cda debt that we all pretended could be converted into stocks,

and cpa is about to default on its bonds,

and schools are still fundraising for toilet paper while students learn in storage rooms turned into classrooms,

and dozens, perhaps hundreds, of government vendors are still waiting to get paid,

then --

$100K-155K per legislator (29 members),

plus $175K-$400K for presiding officers in each chamber (2 chambers),

to spend as they please on baseball teams, congratulatory advertisements, vehicle leases, political hires, tables and tents, donations of drinks, junkets, gifts for their employees to "improve morale", "official representation" and entertainment expenses, subsistence allowances, and community workers to pick up trash and dead dogs and generally duplicate the functions and mandates of existing government agencies,

Heinz overspent his discretionary funds that most of the legislators has dole out to him. In essence, if elected as governor he will dip his hands in every accounts of all branches of government if he runs out of funds in running the government. lets use his logic, why don't we?

he is evidently very confident in the ability of the members of the legislature to distribute any amount of discretionary funds properly (or at least better than a budget would have those funds allocated). so that being said, lets not even create a budget. lets just divide up the whole project revenues for our government by 29 and give each lawmaker an equal share. right?

each lawmaker can then dole it out, responsibly of course (with a bit of waste here and there maybe). why allow any funds to go into the black hole that is the general fund?

each lawmaker can sit in their office and spend the whole of their terms entertaining requests for funds from private individuals, businesses, colleagues and now other government agencies and departments.

if PSS needs funds they can go sit down with Joe or Arnold or Pete and make a personal request. if that lawmaker feels that the request is worthy he can decide how much if any to give PSS. if he says declines to give any of his 5 million in funds to PSS then PSS can go sit down with Tina, Heinz, Rosemond or Ray. if they all decide that PSS is a great thing and they throw a million each at PSS than PSS lucks out and they walk away with 29 million in that one request.

CUC can send a person to solicit (whoops i mean ask for funds... solicitation is not allowed in the legislature). and the same thing can ensue.

no need for budgeting. no need for accountability. no need for oversight. no need for communication. no need for common sense. right?

If he wasts to be know for giving to PSS he should use his own funds not money that can not ever legally belong to him (NO DOUBLE DIPPING).

Oh, my! But I never made that "straw man" argument. Of course improved budgeting is better.

Yet given the current system of $150,000 for each legislator, what is the best approach? Let it lapse into the general fund, or donate it to a needy agency like the Retirement Fund retiree account?

I'm not saying this is the decisive issue for me as to whether or not I'll vote for Tina. It's not.

What I am saying is that YOUR inability to ever concede a "mistake" by yourself or her, or even admit that someone else's ideas might have some merit, is reducing your own credibility on issues where you are correct. And indirectly some of that may rub off on her.

I am not angry in the slightest. To get or remain angry at someone is to give that person power over you. I do not choose to give anyone such control over my life.

I do occasionally get irritated at your rudeness and lack of respect for others, but that quickly passes as I turn my attention to more important things.

As for your online argumentation on the issues or about other people, your major shortcoming is a tendency to jump to conclusions -- as to facts underlying your policy views, and as to acts or motivations of people you choose to excoriate.

For example, Ben Fitial, while surrounded by his share of sycophants (Saipan seems to be awash in them) actually brooks a more robust internal debate on policy matters than most other CNMI leaders. Change can come from within or without. Neither has a monopoly on truth, hurtful or otherwise.

I respect the honesty and integrity of Ben Fitial, Cinta Kaipat, Tina Sablan, and Angelo Villagomez, all of whom I am leaning toward voting for.

But if you engage in too many dirty tricks on Tina's behalf, maybe I'll just vote for one senator.

The argument is not that moneys unspent are later ill spent as appropriations from the General Account. The argument is that allocated a given sum ($96,000 or so this year I think), that Tina seemed unable to reallocate it in a positive way. So che chose the easy way out. I won't prepare a budget and use that money effectively. I'll just whine about others misspending theirs and do nothing. Nothing is exactly waht she has accomplihed with it all right. After railing about the benefits of a variety of projects she uses the funds to advocate for none of them.

If her fixation on transparency is at such a fever pitch then by all means disclose every dime. If spent on advertising to 'educate' the public on her way of thinking, then so be it. If spent to promote OGA application to the Legislature, so be it. OR whatever projects she thinks are for the benefit of her constituents and/or for the rest of the residents of the CNMI.

Instead she sits on her hands (or in this case on her wallet) and does precisely nothing with this possible tool for good.

It is important to note that the discretionary budget should have been drastically reduced or removed upon creation of the Legislative Bureau or the other way around. Having both a $150K discretionary budget and a fully funded LB is not very fiscally responsible at all.

why would you call a lawsuit that gathered information the legislature should have requested a political one? the Acting AG himself - the one defending the governor and finance - stated on record numerous times that it was not only the right of the legislature to find out how much was spent and from where but also their responsibility.

the legislative body did not care to do so and did not do so. they shrugged their duty. all but one legislator that decided to go about it via the OGA (a tool any citizen should be allowed to use without criticism in a democracy).

guess what. she got the info and now the cnmi knows that ben lied to the legislators and the people. eloy himself went on camera just a week after the first payment was cut and stated to MCV that "no public funds were used to pay anyone for the 903 lawsuit".

These last two comments really highlight in stark relief two competing visions for the Commonwealth.

One is a plan of action during times of trouble. Deliberate, plodding, but things get done. The best of island resilience and respect.

The other is “visionary,” bold, brash, confrontational, idealistic, favoring change for its own sake and casting aside useless remnants of our past like religion and culture. We are making a new culture now and we need forward-thinking leaders of the new generation like Glen Hunter and Tina Sablan to show us the way and tell us what to think.

The former Acting AG made few or no statements on the record, certainly not the one ascribed to him immediately above, likely because he had been sued in his individual capacity by Tina, subjecting him to the possible loss of everything he has worked for his entire life and potentially depriving his sons of a college education. The Superior Court quickly dismissed him from the case, but the threat remained until the Supreme Court issued its mandate.

Is this how we recruit and retain professionals to serve our people?

the AG was included in the initial case because the letter of denial never came from the governor's office it came from the AG's office and was signed by the Acting AG.

if tina really wanted to damage the Acting AG at the time she could have (lord knows i would have). the AG never saw any of the documents when the office of the governor was handed the OGA request from tina. the Acting AG simply denied the request en masse without ever gathering all the documents requested, analyzing them and then deciding what could and could not in their opinion be released. if more time was needed to do this the Acting AG could have asked for time. he didn't. he issued a flat out denial. that is outright ILLEGAL. AGAINST the OGA directly and completely and no judge would ever deny that and the Acting AG would be personally liable if anyone brought that to court. be thankful she simply included you in the case because you SHOULD have had the records (since the constitution states that YOU should have been handling the 903 litigation or at bare least privy to it).

The latter is a brave and courageous act against long odds to stand up for his people and save the Commonwealth against those who have not fully considered the grave economic consequences of their legislation on the CNMI, not giving us the benefit of even an Environmental Impact Statement as would be mandated for any construction project in the country -- let alone a major social and economic restructuring.

On the other hand, the conscious choice to sue a government employee in his individual capacity, to attempt to bankrupt a public servant who has dedicated years to humbly serving the people without seeking office for himself admits of only two conclusions -- either the litigant puts personal political success and power above all other considerations (a lawsuit against a defendant in an official capacity would have been just as effective), or is receiving some very poor legal advice.

Either way, this is not the direction we wish to take our Commonwealth. We have way too many lawsuits trying to take money out of each other's pockets already. That is the kind of greedy or vindictive lawsuit we don't need.

You wonder why it is hard to recruit doctors and professionals to the CNMI? Such lawsuits by legislators and others against them are matters of public record. They have very real consequences. It is time to elect legislators who will do their jobs rather than exacerbate CNMI societal litigiousness.

Check the first page of the petition for mandamus and every motion filed after that until Baka was relieved. "Sued in Official Capacity" is all over those docs. Of course, you'd have to actually read the docs to know that.

OGA allows for government officials to be held personally responsible for deliberate violations of the law -- sometimes they even have to pay penalties out of their own pockets! (I don't think that's ever happened in the CNMI, but lord knows it should.)

And yeah, I'd say there were some pretty deliberate-looking violations of the law in this particular case -- not reviewing the documents at all before issuing the blanket denial, turning over documents late, incomplete, etc.

Sorry, no sympathy for government officials who don't respect the rule of law... no matter how many kids they have to put through college. That's hardly a defense and not at all a reason for leniency.

If telling Filipinos to "GO HOME!" and telling U.S. Congresswoman Donna Christensen and visiting U.S. officials that the Filipinos outside the Guma Hustisia are all "illegals who need to be deported" is character, then so be it.

If surrounding yourself with crooks and drug dealers, from your Lt. Governor to your personal bodyguard and driver to your commerce secretary to your lobbyist in America Jack Abramoff to your senior policy adviser who has ZERO college degree and a history of beating up on Filipinos and choked a student at NMC is character, then so be it.

If promising better times and bringing the worst of times and then finding excuses for why times are so bad is character, then so be it.

If leading by "emergency declarations" is character, then so be it.

If sole-sourcing millions of dollars of contracts to political friends and family is character, then so be it.

If firing highly qualified people because they disagree with you is character, then so be it.

If reneging on a promise of not touching CNMI funds for a federalization lawsuit only to end up using it and then FAILING to disclose how much is being spent is character, then so be it.

If running CHC to the ground to the point where there is no nephrologist, no lab director, half of the required blood supply, doctors leaving abruptly and suddenly, and making CHC a shell of what it once was is character, then so be it.

If circumventing CNMI law by exceeding the number of days an attorney general can be "acting" is character, then so be it.

If bowing down to WILLIE TAN because he gave you a ton of money and favors is character, then so be it.

Ben Tan has no character. What he does have his a track record of lying, deceiving, and spinning the truth. Ben Tan will certainly lose this election because he will never be able to get 50% plus 1 of the votes. He will be lucky to get 20%. Off-island voters hate Ben Tan, for they left because things were so miserable here.

Ben Tan will be gone come January, and he will be a memory of the past and we can use his four years of lying as a blueprint on what NOT TO DO when Governor.

The nice thing is that we will see the Fitialites removed as well, from GARMENT WHORES Dick Pierce to Lynn Knight to POLITICAL WHORES Deanne Slimer and Howard Cryptkeeper Willens to THUGS Ramon Mafnas and ice dealer/personal bodyguard Pete Reyes to the INCOMPETENCE of Melvin Faisao, Candy Taman, and a horde of others.

Ben Tan is going to lose and lose big. Charlie Reyes Jr hopefully will find a girlfriend and hopefully he won't sue her. Ramon Mafnas will hopefully enter the octagon and see if he can still choke out Korean students or beat up on Filipinos. Howard Willens and Deane Seimer will hopefully get a fucking makeover or finally decide to put a bag over their heads. Deane, for the love of God, you do not have to look that ugly. Lynn Knight will hopefully find love and will stop screwing married men and can find a job as a lobbyist and let her mouth work overtime under the desks of executives.

The people of the CNMI are fed up with the Tan Dynasty. It is time to create their own destiny without Willie Tan and his puppet Ben Tan.

When it rains it pours. Is it true that another officer in Fitials army has been charged with a crime? Franz Reksid? I think we will have to use some of the ARRA funds to build a new jail. We can dedicate it to this administration by naming it “Fitial’s Big House”. What is that? The 10th person closely related to Fitial to be charged in the last 6 months? I know now why DEA may not “like him”.


I also heard a rumor that an AG is being looked into. Anyone have more on this? Which one? Why?

Is this the same Deanne Siemer that was charged with gross ethics violations while prcticing law int he mainland less than 10 years ago? Wasn't she fined $500,000 and removed from the case and disbarred from practicing law in that state and removed from that firm? Didn't they include that ethics violation case in the textbooks that lawyers now study on WHAT NOT TO DO and use her as an example?

Why on earth are we allowing her to volunteer out here? Fitial keeps some very surly characters close by him.

Maybe she is volunteering because she can not legally practice since she had that ethics violation?

Can someone clear up or verify any of this info?

ADMINISTRATION UPSET AND WILL NOT MOVE ON

by The Truth Reporter


The current Administration is extremely upset at a carry over from the previous administration that he believes is responsible for this controversy.

“After looking into this Reyes incident more thoroughly it is clear now,” said Charles, “that a former Babauta appointee from the previous administration is responsible for everything.” Fitial is furious that his initial desk audit of political loyalist did not turn up this individual who is responsible for this current incident when he took office. “At that time I put in place my buddies in every department. Their mission was simple. Check all staff and remove anyone tied to any party other than the Covenant Green party. I was assured this had been done! I am appalled that one slipped through. Heads are going to roll.” He went on to say, “ after the Local DPS covert and surprise drug bust slated for Friday at 2:00pm he will assemble the one remaining department head and all acting department heads and find out who is responsible.”

Reporters have discovered that the person that is the focus of Fitial’s anger is one Joe Senpasdot. He apparently was put in charge of destroying public records and inadvertently forgot to burn all outstanding drug test results and inter department evaluations and communications. We contacted him for a response but he was unavailable at the time. His wife however is asking for the communities help. It appears he has been missing since this story broke 5 days ago.

Fitial asked that we include a quote from him in this article. “This is just another negative result of Federalization. Please DEA do not bring charges against Pete Reyes. Like me, he is allergic to lawsuits. Let it BE!”
