Did Anyone Notice the Temporary Exit Notice?

Saipan Tribune has run two stories about this latest directive (well, not latest according to the Labor Department) about aliens with work permit would have to fill out a form available online from the DOL that would notify the department that they are temporary leaving the island. While the form does not ask for the destination, according to sources, DOL staff had told them that even if the aliens are going to Guam for a business visit or pleasure visit would still have to file for the notice.

Tribune has repeatedly told readers that it had asked about the date of implementation of this rule and the paper said that DOL had referred them to the PL 15-108 enactment. When was the PL 15-108 implemented? How come some people that had vacation last month that were not aware of the requirement thus failed to file the document were allowed back in the CNMI?

Some workers left for Guam today and called their offices that they had heard about the news just yesterday and got so worried about the news. Now the paper again is saying that one nurse was refused entry to the CNMI due to non-compliance.

However, the news is also right about how easy it would be to file the document.

It's really astonishing that Lil Hodges are still in total denial. They cannot answer this one question clearly: Will contract workers who do not hold H Visas be allowed to stay in the CNMI? How about this one: Will contract workers get green cards? They will not answer this. They dance around it with emotional rants, yada yada yada. If any money was given to the Dekada people on behalf of these contract workers, they should be sued for fraud along with Tina Sablan, their lawyer, Wendy, etc. The contract workers should do this quickly though, time is running out.

PL 15-108 (at 3 CMC 4951) includes the following notice provision:

"A foreign national worker who exists the Commonwealth during the term of an approved employmentt contract for any purpose other than employment shall inform the Departent of the date of exit and date of return. No final administrative order shall be entered during the absence of a foreign national worker in compliance with this section prior to the date of return indicated."

Note that this applies only to "foreign national workers" (nonresident workers). It does not apply to IR's, who are considered "permanent residents." It also does not bar you from re-rentry for failing to give notice. The purpose seems instead to protect the worker from an order being issued affecting him while he is away, thus unaware of it.

The new Emergency Regulations (enacted in response to the new federal requirement that the total number of foreign workers in the CNMI not increase) are very different. They apply to all "foreign workers," which they define differently as including all foreigners authorized to work, including IR's. And you CAN be barred from re-entry if you do not give notice, because you will be assumed (for no good reason) to have permanently departed.

This is going to be a fiasco.

It's all part of the continuing effort by our department of Labor to harrass non-residents. They've got their panties in a wad over the federal takeover. Kaipat probably jumps up and down in a raging fit every night upon her return home from work.

I forgot, upon her arrival at the home that was probably built by non-resident workers.

From the Unheard No More! website, it looks as if Dekada Shyster is preparing lawsuits for people being deported with labor cases pending, and for people with labor cases dismissed after receiving notice solely by publication.

We have been decieved by the pro federalization group. I am but a simple waitress and will not qualify for an H work visa next year. Before the majority of our guest workers are deported, let us file a complaint against this group and at least leave with some dignity.

File a complaint against the pro federalization supporters for what...and to who? Pro fed supporters want an end to a failed and broken system plagued by corruption that leaves potential for abuse. No one has promised anything. Many pro fed persons favor an improved status to green card with an unobstructed path to US citizenship, but I have never heard anyone promise this or anything else.

We did read the law. Special guest worker program at least through 2014, can be extended forever if needed (the Senate says it expects it to be extended), and the other visas on top of that. Plus status for CGWs will be reviewed within 2 years. No guarantees either way, we know that. Now stop calling people idiots noni and go back to your job at Labor. You should not be typing this scare nonsense on public time.

Wow. The law calls for an end to contract workers idiot. This is why the law was passed to help local workers out, no contract workers. H visas are next to impossible to obtain idiot. Is this like wishful thinking or something? Why do you live in denial? The law does NOT help contract workers out, it does NOT give any new rights, it does call for an end to contract workers. This blog is aiding and abetting the fraud perpetrated by Ron Hodges, Dekada Shyster, Wendy Doromol, and others against the hard-working contract workers.

When you file your lawsuit, be sure to name the people behind this blog as co-defendants. That way you can do discovery and, though IP addresses, determine the identities of other co-conspirators.

But where will you ever find a lawyer skilled enough to challenge Dekada Shyster?

No one will sue him! He is too smart (or too sneaky). Face it, you have been betrayed, and there is nothing you can do about it.

what is bad about opening a sari-sari store in PI? there's a lot of sari-sari store here. and mostly owned by foreigners! don't locals like to have sari-sari store? if you don't want sari-sari store, then, invest in building a MALL!
and if we "go home" not all of us will just open a sari-sari store, we can open our own beauty parlor/salon, tailoring, canteen, restaurant, auto shop, machine shop, dental clinic...name it!

But Ron Hodges, Wendy Doromol, and to a lesser extent Dekada Shyster and Saipan Writer have been peddling these gloom-and-doom, fear-mongering screeds about the Philippines being a "hell-hole," and that the only solution for the "parents of U.S. citizen children" was green cards or amnesty now. (!)

Because of the unceasing nature of these diatribes, some kababayan have actually come to believe there have been "promises" made to this effect.

While often aimed at Washington, D.C., the federalizers have been repeating their rants so often that they have raised fear, alarm, and confusion among our hard-working foreign national workers to the extent that they have forgotten the many options that you have just mentioned.

Their U.S. citizen children can still move to the mainland and petition them (once they get a job with adequate income to serve as a USCIS sponsor) upon turning 21.

It is important, however, that these U.S. citizen children be registered as Filipinos born abroad with the consulate on Saipan, and get Filipino passports, too, so they will have no problem going to high school and college in the Philippines, preparing themselves properly for their big move to the States.

The University of California at Berkeley, for instance, will evaluate a Philippine degree and transcript.

"Foreign" is not the same as "unaccredited" in academic circles. Many foreign degrees are rated equal to a Masters, and B.S. or B.A. from RP would certainly qualify for earning a U.S. Masters Degree.

Why would a three-year-old be sent to the mainland U.S. when her parents would be following up on the RP opportunities Malou Berueco has elaborated on?

In fact, many Pinoys in the U.S. still have their children educated back home in care of the grandparents.
